Gemaskerde inspecteur ontslagen voor onthullen fraude op kunstmarkt<\/h2>\n

Bernard Staessens, lid van de Economische Inspectie en officier van gerechtelijke politie, is uit zijn functie ontheven na de publicatie van een boek waarin witwaspraktijken en zwendelpraktijken van maffia’s in de Belgische antieksector aan de kaak worden gesteld. Om zijn anonimiteit te bewaren verscheen hij gemaskerd als Toetanchamon voor interviews, maar noch het pseudoniem noch de vermomming was voldoende om hem te beschermen tegen disciplinaire maatregelen. <\/p>\n

Wanneer een ambtenaar een gemaskerde klokkenluider wordt<\/h2>\n

In september 2024 onthulde Bernard Staessens op La Premi\u00e8re dat “je op de kunstmarkt in alle anonimiteit koopt”, voordat hij eraan toevoegde dat “het hoofd van een farao in Belgi\u00eb voor ongeveer een miljoen euro wordt verhandeld”. In zijn boek Les secrets du march\u00e9 de l’art en Belgique : enqu\u00eates sur les escroqueries, les fraudes et les pillages<\/em> (uitgegeven door Racine), beschuldigt hij echte criminele organisaties van het recycleren van zwart geld door de aankoop van kunstwerken. Ondanks het gebruik van een pseudoniem en een Toetanchamonmasker werd zijn identiteit snel onthuld. De FOD Economie beschuldigde hem van een “gebrek aan vertrouwelijkheid”, een “gebrek aan neutraliteit en loyaliteit” en “ongeoorloofde communicatie met de pers”. <\/p>\n

Een kunstsector onder invloed van de maffia?<\/h2>\n

De Koninklijke Belgische Oudheidkamer, gevestigd in Zavel in Brussel, reageerde fel en beschreef het boek als “belastend”. Patrick Mestdagh, \u00e9\u00e9n van haar woordvoerders, hekelde het boek als een “schandaal” en wees op de verspreiding van informatie en foto’s uit “nauwelijks verborgen” offici\u00eble dossiers. Hoewel Staessens’ boek de recente inbeslagnames van kostbare voorwerpen belicht, werpt het vooral de vraag op welke rol de kunstmarkt speelt bij het witwassen van geld. In de praktijk lenen archeologische artefacten zich uitstekend voor transacties ter waarde van miljoenen euro’s, die ontsnappen aan elke strenge controle door een gebrek aan traceerbaarheid en onvoldoende middelen voor onderzoek. <\/p>\n

Een overheidsinstantie die heen en weer geslingerd wordt tussen de plicht om terughoudend te handelen en de noodzaak om te waarschuwen<\/h2>\n

De disciplinaire sanctie werd opgelegd: ontslag ambtshalve. Volgens de FOD Economie had de werknemer nevenactiviteiten ondernomen tijdens de werkuren en had hij de waardigheid van zijn functie aangetast door zich herkenbaar te maken als auteur van het boek en het departement te vermelden. Eind oktober 2025 schortte de Raad van State het ontslag echter op en vernietigde het. Twee van de vier klachten tegen Staessens waren onvoldoende onderbouwd en het bestuursorgaan had niet aangetoond dat hij zijn project volledig had verzwegen voor zijn superieuren. Deze beslissing benadrukt de spanning tussen de loyaliteit die een ambtenaar verschuldigd is en zijn potenti\u00eble rol als klokkenluider. <\/p>\n

Beroep bij de Raad van State en de juridische aspecten daarvan<\/h2>\n

In Belgi\u00eb loopt de omzetting van de Europese richtlijn over de bescherming van klokkenluiders (2019\/1937) achter op schema, vooral voor ambtenaren. De rechters herinnerden eraan dat de vrijheid van openbare meningsuiting, wanneer die het algemeen belang dient, voorrang kan hebben op de verplichting tot terughoudendheid. In het bijzonder oordeelde de administratieve rechtbank dat de Inspectie niet had gerechtvaardigd waarom de publicatie van de onthullingen aan een strikt verbod was onderworpen. C\u00e9dric Molitor, advocaat van Staessens, wees erop dat zijn cli\u00ebnt bepaalde kaderleden op de hoogte had gebracht van zijn plannen. Aan de andere kant blijft de Chambre des Antiquaires de inhoud betwisten met het argument dat het gebruik van interne dossiers in strijd is met de ethische regels. <\/p>\n

Naar een betere bescherming voor klokkenluiders en regulering van de kunstmarkt<\/h2>\n

Afgezien van de zaak Staessens roept deze affaire een aantal vragen op: hoe kunnen we degenen die systematische fraude melden beschermen zonder de werking van openbare diensten in gevaar te brengen? Hoe kan de kunstmarkt worden hervormd om de anonimiteit te beperken en de traceerbaarheid te versterken? De cijfers spreken voor zich: meer dan 1.000 doorgestuurde witwaszaken in 2024, 1,4 miljoen euro in beslag genomen tijdens een operatie in Brussel en een antieksector waar kunstwerken zonder strenge controles worden verhandeld. Uiteindelijk zal de regering moeten beslissen of ze de strijd tegen het witwassen van geld opvoert door middel van strengere wetgeving en meer middelen, of dat ze een status-quo tolereert die bepaalde lobby’s bevoordeelt. <\/p>\n

Voorlopig blijft Staessens geschorst, maar zijn procedure voor de Raad van State zou kunnen leiden tot zijn heraanstelling, wat de weg opent voor een publiek debat over de plaats van klokkenluiders in de administratie en de behoefte aan een transparantere regulering van de kunstmarkt in Belgi\u00eb.<\/p>\n","protected":false},"excerpt":{"rendered":"
